Terms
Plain English. This is the contract.
These terms govern bidding on, and sponsoring, advertising positions on the vehicle described on outdrive.lol (“the car”), operated by Mike Planzer (“the operator”). Placing a bid means you accept them and the sponsor policy.
1. The auction
- Each slot has a floor price in CHF per month. A bid sets a monthly rate at least CHF 10 above the current price (or at the floor if there is no bid).
- Placing a bid authorises a deposit on your card of 20% of the first month, minimum CHF 10. This is an authorisation, not a charge. If you are outbid it is released in full and you are notified by email.
- A bid placed within the final 5 minutes of a slot's clock extends that slot's clock by 5 minutes.
- Bids are binding. The total commitment (12 × monthly rate) is shown before every confirmation.
- Ghost slots (CHF 10/month) are fixed-price, unlimited, and carry no physical placement.
2. Close, the line, and collection
- All or nothing. If the combined monthly run rate of all slots at close is below CHF 433/month — the operator's actual lease cost — every authorisation is released, no decals are applied, and the campaign is publicly cancelled.
- If the run rate is at or above the line, each winner is charged month 1 plus a deposit equal to the final month immediately at close. Months 2–11 are billed monthly by card. The final-month deposit covers month 12.
- Upfront option. Any winner may instead pay 12 months in one payment for the price of 10.
- Crypto, token, exchange and DeFi sponsors are prepaid-only: 12 months in one payment, no monthly option. This is enforced at checkout.
- A winner whose payment fails and is not settled within 7 days forfeits the deposit and the slot returns to auction.
3. The term
- Every contract runs 12 months starting on the day the decals are applied, not at auction close.
- Decals are applied only after written consent from the vehicle's lessor. If consent is refused, all payments are refunded in full and the campaign is cancelled.
- Livery is cut vinyl decals and lettering on the existing paint. It is not a colour-change wrap.
- Sponsors approve their artwork at size before it is cut. The operator may decline artwork under the sponsor policy.
- Renewal. At the end of the term the slot returns to auction. The incumbent holds first refusal at their last price + 10% for 7 days.
4. The vehicle, substitution, and write-off
- Substitution. The car is leased and the lease may end before some contracts do. The sponsor is guaranteed an equivalent-or-better vehicle for the remainder of the term, or a pro-rata refund of unused months, at the sponsor's choice.
- Accident or write-off. If the car is off the road for more than 14 consecutive days, the term pauses. If it cannot be returned to service or substituted within 60 days, unused months are refunded pro-rata.
- Refund reserve. 10% of all funds collected are held in a stated reserve for the refunds above and are not treated as income until the corresponding months have been delivered.
- Removal. Decal removal at the end of the term (CHF 800–CHF 2’000) is paid by the operator from collected funds and is shown in the public budget.
5. What is delivered
- Placement of the sponsor's logo on the agreed position for the term.
- A monthly report of distance driven, cantons visited and ferry crossings, derived from the car's telemetry. Routes are published after a minimum 24-hour delay and aggregated; anything within 500 m of the driver's home is never shown. Real-time position is never published to anyone.
- Every photograph published by the operator in which the sponsor's logo is visible, delivered to the sponsor with a perpetual, non-exclusive licence for the sponsor's own marketing. The operator retains copyright.
- Name and link on this site and the live map for the term.
- The operator does not guarantee any number of impressions, views, or crossings. The routes described are the operator's genuine habits, not a schedule.
6. Invoices, tax, refunds
- A proper invoice is issued for every payment, stating VAT status. Revenue is declared and taxed as income.
- Refunds under these terms are made to the original payment method within 14 days.
- Except as set out above, payments are non-refundable.
7. Conduct
- The sponsor policy lists refused categories and is part of these terms.
- The operator may remove a decal early, with a pro-rata refund from the reserve, if the sponsor's business changes into a refused category or if the placement becomes unlawful.
- The sponsor warrants it has the rights to any artwork supplied.
8. Law
Swiss law applies. Place of jurisdiction is Zurich. If a clause is unenforceable the rest stands.
9. Privacy
Bidder names are shown publicly on the board. Emails are used for auction notifications, receipts and monthly reports only, and are processed by Stripe (payments) and Resend (email). No live vehicle location is stored in a form that is ever published.
